1. General
1.1 Easysmoke OÜ is a service provider which has created the web shop www.easysmoke.ee for selling products to the users of the service.
1.2 A customer is a user of the service who places an order in web shop www.easysmoke.ee and identifies himself by entering his personal data in the order.
1.3 Easysmoke OÜ may unilaterally alter the terms and conditions and modify the web shop service at any time without any obligation to notify the user in writing thereof
2. User of service
2.1 The user of the service may be:
1) Physical person at least 18 years old;
2) A legal person
2.2 The user declares that he is a physical person at least 18 years old.
2.2.1 In view of the above, Easysmoke OÜ can reasonably assume that the user is at least 18 years of age.
2.3 Easysmoke OÜ may refuse to enter into a contract of sale if it learns that the user is a natural person below 18 years of age.
2.4 The user declares that he has reviewed the terms and conditions of Easysmoke web shop before effecting the sale/purchase transaction and agrees and undertakes to comply with the said terms and conditions.
3. Prices
3.1 All prices in the web shop are in euros and include the 20% VAT established in the Republic of Estonia.
3.2 Easysmoke has the right to change the prices displayed in the web shop at any time.
4. Products
4.1 The quantity of goods on sale is displayed with a time delay and it may differ from the actual state of the warehouse.
4.2 If the product is out of stock or the order cannot be fulfilled, the web shop employee will contact you and offer a possible new delivery time or replacement of the product with an equivalent product of the same price and quality, or the money paid for the product will be returned. 4.3 Product information is checked and improved regularly. The data may have been updated since your last visit.
5. Purchase procedure
5.1 When purchasing from the Easysmoke web shop, proceed as follows:
1) Select the desired products and enter the necessary data to complete the order (first name, last name, contact number, e-mail address, city);
2) Choose a suitable item delivery point;
3) After completing the order, we will send an order confirmation to your e-mail;
4) You can pay for the products by bank transfer, credit card or Estonian bank links (Luminor, Swedbank, SEB, LHV). Upon confirmation of the order, you will be directed to the bank, where a pre-filled payment order is waiting. When paying by bank transfer, use the data on the order confirmation as a basis;
5) After placing the order and payment, the Customer will receive an order confirmation by e-mail.
6. Cancellation of order
6.1 The customer has the right to refuse the purchase within 14 calendar days from the day of receiving the goods. The customer is obliged to inform EasySmoke (Easysmoke OÜ) of his wish at the e-mail address [email protected]. The reason for returning the products must be stated in the statement.
6.2 If the order cancellation request reaches us after the execution of the contract, the contract will be withdrawn in accordance with section 7 "Right to Return" of the Terms and conditions of the web shop.
6.3 Upon termination of the contract, the purchased goods must be returned within 14 calendar days.
6.4 Money for the returned goods will be transferred to the Customer's current account as soon as possible, but no later than within 14 working days after the products have been returned to the seller.
6.5 The money is transferred to the same account from which it was received by Easysmoke OÜ.
7. Right to return
7.1 Products purchased from the web shop are subject to a 14-day right of return from receipt of the products
7.2 In case of return, proceed as follows:
1) In order to return the product, you must submit a corresponding letter to the e-mail [email protected].
2) When withdrawing from the contract, you must return the purchased product within 14 days after notification of the withdrawal from the contract.
3) Make sure that the product to be returned is complete, in the original packaging and unused, the original invoice must be attached to the product when returning it.
7.3 If, after returning the product, it appears that the product does not meet the criteria set out in section 7.2 of the web shop User agreement, the User will not get a refund and the returned product will be stored at the service provider. Any expenses arising from returning the stored products shall be covered by the service user.
7.4 Upon return, you will be refunded, but no later than within 14 calendar days of returning the product.
7.5 Products that do not match the order have the right to be exchanged within 14 days.
7.6 The money is transferred to the same current account from which it was received by Easysmoke OÜ.
8. Warranty and return of non-compliant products
8.1 Easysmoke OÜ is responsible for the non-compliance of the products and defects that appear within 2 years from the handover of the products to you.
8.2 Easysmoke OÜ is not responsible for:
1) For product damage caused by your fault;
2) For defects that have arisen as a result of improper use of the product;
3) For normal physical wear and tear of the product under normal use.
8.3 In the event of returning a non-conforming product, the amount paid for the product shall be refunded to the bank account indicated by you not later than 30 days after receiving the notice of withdrawal and the request to return to product.
8.4 The warranty against defects excludes the atomiser. The atomiser is a consumable.
8.5 The battery’s warranty is 6 months or 300 charging cycles.
8.6 The document certifying the validity of the warranty of the purchased product is the sales invoice and/or purchase receipt.
8.7 The warranty period starts from the moment when the customer has received the goods indicated on the invoice/delivery note. The manufacturer's warranty is valid for six months.
8.8 The customer undertakes to remove the device within three (3) months from the completion of the work. If this term is exceeded, EasySmoke OÜ has the right to dispose of the device.
9. Personal data and their processing
9.1 All personal data of the customer that becomes known in the course of visiting the web shop and retail store and making purchases is treated as confidential information.
9.2 The source of personal data is the creation of a customer relationship when registering an order in the web shop and when registering as a regular customer in a retail store.
9.3 Personal data are first and last name, date of birth, telephone number, social security code, e-mail address, residential address, IP address.
9.4 Secure data communication and security systems are used when requesting card data. An encrypted data communication channel with banks ensures the security of your personal data and bank details. The service provider cannot see the entered card data. To perform the transaction, the card holder is directed to the secure environment of EveryPay AS. At the time of payment, the card holder's card data is entered into the database located on the Card Center's server by the card holder, and the data is also stored on the Card Center's server.
9.5 Easysmoke OÜ's business software and web shop database stores the purchase history of the Service user, which is used in warranty cases.
9.6 Easysmoke OÜ undertakes not to forward personal data to third parties, except for:
9.6.1 E-mail transmission service provider, in cases where Easysmoke OÜ transmits informative news to the Service user;
9.6.2 To the developer of the web environment, in so far as it is necessary to ensure its smooth operation.
9.7 You have the right to check your personal data, as well as change them, request their removal, limit their processing and request their transfer.
9.8 The user of the service gives Easysmoke OÜ consent to send order confirmation to the e-mail address entered when placing the order; information about non-receipt of payment.
9.9 The personal data of the service user will be stored indefinitely until the consent is withdrawn by the service user.
9.10 If the user of the Service has expressed a wish to receive newsletters, the user of the Service always has the right to opt out of them by clicking on the corresponding link shown in each e-mail or by sending a corresponding notification to the e-mail address of Easysmoke OÜ at [email protected]
